The Kerala High Court has permitted termination of a minor rape survivor’s pregnancy at 30 weeks and directed the state to arrange the procedure, according to reports published by Law Trend and Madhyamam on October 1.
The decision followed an assessment by a court-appointed medical board that continuing the pregnancy would seriously affect the survivor’s mental health. The court required a written undertaking confirming her willingness before the procedure could proceed.
Madhyamam reported that the board warned of a possible live birth and a need for intensive neonatal treatment. If the baby survives, the state must provide appropriate care and treatment for complications. These were medical assessments and court directions, not confirmed outcomes.
Law Trend also reported an instruction to preserve tissue and blood samples for forensic examination if the baby does not survive, because a sexual-assault case has been registered. The reports do not establish that the procedure has already taken place.
